Access to and use of the DMY (Data Management Yield) software, including predictive analytics for production downtime and material shortages, is subject to these Terms of Use.

By using the service, you confirm that you have read, understood, and agree to these terms.

2. Description of the Service

DMY Berlin Logistics provides a software platform that analyzes big data to streamline logistical throughput via the Rotterdam-Berlin corridor. The service includes:

• Optimization of 'Just-in-Time' supply chains.
• Prediction of production downtime and material shortages.
• Data-driven insights for supply chain optimization.

3. User Obligations

You are obligated to:

• Provide accurate and complete information for the software's operation.
• Keep your access credentials confidential.
• Not use the software for unlawful purposes or to disrupt the system.

Any breach of these obligations may lead to immediate termination of your access.

4. Intellectual Property

All rights to the software, algorithms, interfaces, and associated documentation are and shall remain the exclusive property of DMY Berlin Logistics. You only obtain a limited, non-transferable right to use the service as intended.

5. Limitation of Liability

Our software is a decision-making tool. DMY Berlin Logistics is not liable for indirect damages, consequential damages, or business loss resulting from the use of the predictive analytics, including but not limited to delays in the supply chain.

We do not guarantee that the service will function uninterrupted or error-free.

6. Modifications and Termination

We reserve the right to modify or terminate these terms, the functionality, or access to the service at any time. We will notify users reasonably of substantial changes.

7. Governing Law

These terms are governed by Dutch law. Disputes related to these terms shall be submitted to the competent court in Rotterdam.
